Temporary workers' visas
& workers qualified for permanent residence

1. How many classifications of temporary workers are there and what
are they?
There are twelve classifications of temporary workers:
H-1A applies to registered nurses
H-1B applies to those persons who have special knowledge after
taking specific course of higher education. This classification requires
a labor attestation issued by the Secretary of Labor (Annual quota is
65,000).
H-2A is a classification for temporary and seasonal agricultural
workers.
H-2B is a classification for temporary and seasonal nonagricultural
workers. Workers in this classification are required to have temporary
labor certification issued by the Secretary of Labor (Annual quota is
66,000).
H-3 this classification applies to practical training in the education
of handicapped children (Annual quota is 50); as well as to trainees other
than medical or academic field.
L classification applies to intracompany transferees for employees
with managerial, executive or specialized knowledge who will be employed
by an affiliate organization of the same employer in the United States.
O-1 classification applies to those persons who have extraordinary
ability in the sciences, arts, education, business, or athletics or motion
picture and television.
O-2 applies to those persons accompanying an O-1 alien to assist
in his performance.
P-1 classification applies to individual or team athletes or members
of an entertainment group with international recognition (Annual quota
is 25,000).
P-2 classification applies to those artists and entertainers who
will perform under a reciprocal exchange program.
P-3 classification applies to artists or entertainers who perform
under a culturally unique program, (Annual quota is 25,000).
Q-1 classification applies to participants in an international
cultural exchange program for the purpose of training and sharing of the
history, culture and traditions of the alien's home country.
2. How many categories are there for granting permanent residence
to foreign nationals based on employment skills?
EB-1 is a classification for Priority workers. Priority workers
are foreign nationals of extraordinary ability in the sciences, arts,
education, athletics, researchers, professors and business executives.
EB-2 is a classification for professionals with advanced degree
or persons with exceptional ability in the sciences, arts or business.
EB-3 is a classification for skilled or professional workers with
minimum of two years training and experience.
EB-4 is a classification for special immigrants such as foreign
religious workers and employees and former employees of the U.S. Government
abroad.
EB-5 is a classification for immigrant investors.
